Borough Petty Sessions, Bury, Thursday, February 9.

Game Trespass.

Isaac Emmerson and John East, old offenders, who did not appear, were summoned for being on land by night for the purpose of taking game.

James Barnes, keeper for Mr. Josselyn, deposed that on January 30, at 7.30 a.m., he saw Emmerson come out of a plantation. He ran across the field, and saw him and another man who joined him on the road. He kept in front until he came to his own two men. He seized Emmerson and held him while Claxton took a gun (produced) out of his pocket. East had a pheasant, but witness did not see him on land of Mr. Josselyn's.

David Claxton deposed that he saw Emmerson and East on the road. He took a gun from Emmerson, and a fresh hen pheasant from East.

Emmerson was sentanced to two months' imprisonment, and to find sureties for twelve months; in case of failing to find sureties to be further imprisoned for six months. The case against East was dismissed.
